GamBlock® for Help Organisations Agreement
At the end of the payment process WorldPay will provide you with a Transaction ID. I acknowledge and agree that I will store my Transaction ID in a safe place.
If the GamBlock® Browser on Google Play is not used to make an Android product selection, the terms and conditions on this site will apply for the applicable device mentioned on this site via using the GamBlock® Browser.
Gamblock Pty Ltd is not obliged to remove GamBlock® from a Customer's operating system upon request by the Customer. The Customer hereby releases Gamblock Pty Ltd from any liability or claims whatsoever arising out of or connected with Gamblock Pty Ltd not removing GamBlock® from the Customer's operating system.
If instructions are not followed at the end of a protection period and the device, and / or applications are no longer supported by GamBlock®, Samsung or Android / Google, ongoing support is not provided where it becomes unreasonable in Gamblock Pty Ltd’s opinion.
If instructions are not followed at the commencement of a protection period, including but not limited to registration, and / or instructions are not followed at the end of a protection period within one month of protection period cessation, the charge for Support to remove the GamBlock® application\s will be $USD20.00 per device.
GamBlock® blocks all forms of online gambling, including, but not limited to, apps that offer gambling, gambling information, hidden gambling (not displayed on the computer/mobile phone or device), spread betting, fantasy games, lotteries, bingo, sportsbook, sweepstakes, gambling software and sites that pertain to "real world" gambling.
GamBlock® for Help Organisations protection is per device.
GamBlock® Ultimate Help Desk Agreement
I acknowledge and agree that all GamBlock® Ultimate Help Desk appointments will be confirmed in New York current local time or Greenwich Mean Time and that if I am unavailable at the agreed time, without providing twenty four hours notice, ten minutes will be docked from GamBlock® Ultimate Help Desk.
I hereby release absolutely Gamblock Pty Ltd; it's officers, employees, servants or agents from any liability, loss or damage howsoever suffered that may arise as a consequence of accessing my computer directly and hereby indemnify absolutely Gamblock Pty Ltd, it's officers, employees, servants or agents from any claims that may be made against them as a consequence of accessing my computer directly.
GamBlock® Ultimate Help Desk may be recorded for training purposes. Where communication of a threatening, abusive or offensive nature is not directed at Gamblock, it's officers, employees, servants or agents, Gamblock will delete the recording upon request.
I acknowledge and agree that if I initiate or partake in a communication of an emotive or non-technical nature directed at Gamblock or any of its employees, servants or agents, Gamblock may, at its option, terminate GamBlock® Ultimate Help Desk immediately.
I acknowledge and agree that any telephone calls will be taken by a person who is aware of gambling harm.
Poor connectivity and crimeware may impede GamBlock® Remote Support. Hidden malware may be the most resource intensive process on a computer.
Microsoft® Windows® or Apple® Macintosh® settings may need to be temporarily changed if remote access to the computer is required. Changes may need to be made to security settings, anti-virus and third party programs. GamBlock® does not open personal files, such as documents, spreadsheets, pictures or the like.
GamBlock® for Windows Corporate Agreement
At the end of the payment process WorldPay will provide you with a Transaction ID.
I acknowledge and agree that I will store my Transaction ID in a safe place.

GamBlock® Corporate is not for personal use.
GamBlock® blocks all forms of online gambling, including, but not limited to, gambling information, hidden gambling (not displayed on the computer/mobile phone or device), spread betting, fantasy games, lotteries, bingo, sportsbook, sweepstakes, gambling software and sites that pertain to "real world" gambling.
Due to the architecture of Microsoft® Windows® 8, some Metro tiles are blocked to ensure that gambling can not be accessed.
GamBlock® protection periods are per computer.
GamBlock® for Windows Small Business Agreement

Gamblock Pty Ltd is not obliged to remove GamBlock® from a Customer's operating system upon request by the Customer. The Customer hereby releases Gamblock Pty Ltd from any liability or claims whatsoever arising out of or connected with Gamblock Pty Ltd not removing GamBlock® from the Customer's operating system.
GamBlock® Small Business is not for computers that are controlled by a System Administrator or computers that are solely for personal use.
GamBlock® blocks all forms of online gambling, including, but not limited to, gambling information, hidden gambling (not displayed on the computer/mobile phone or device), spread betting, fantasy games, lotteries, bingo, sportsbook, sweepstakes, gambling software and sites that pertain to "real world" gambling.
GamBlock® may, at its option, block software that is incapable of recognising digital signatures, to ensure operating system security.
If GamBlock® Ultimate is required to remove non-Microsoft security software, the equivalent cost will be taken off the end of the computer’s protection period.
Due to the architecture of Microsoft® Windows® 8, some Metro tiles are blocked to ensure that gambling can not be accessed.

GamBlock® for Windows Personal Agreement

GamBlock® Personal is for personal use only and not for home businesses.
GamBlock® blocks all forms of online gambling, including, but not limited to, gambling information, hidden gambling (not displayed on the computer/mobile phone or device), spread betting, fantasy games, lotteries, bingo, sportsbook, sweepstakes, gambling software and sites that pertain to "real world" gambling.
GamBlock® Personal will not install on a system managed by a System Administrator, such as a work laptop / computer, that does not give full install / administrator permissions to the person installing GamBlock®.
GamBlock® may, at its option, block software that is incapable of recognising digital signatures, to ensure operating system security.
If GamBlock® Ultimate is required to remove non-Microsoft security software, the equivalent cost will be taken off the end of the computer’s protection period.

System Requirements
2.1
(a)
The GamBlock® Purchase app must be used to check compatibility on Android devices.
2.2
If a system requirement described in Clause 2.1 is not met, the protection period cost of the device pertaining to that system requirement will be added to the protection period of a device/s that meets the system requirements described in Clause 2.1.
2.3
Huawei devices can diverge greatly from Android operating systems released by Google and I understand that extra steps and remote assistance at no extra cost may be required to complete installation.
3.
Functionality
3.1
Applications must be approved by Gamblock Pty Ltd.
3.2
Accounts cannot be added to the device. However, accounts can be accessed by applications such as the GamBlock® Browser.
4.
Device Divergence
Non-Samsung devices can be divergent where Android fragmentation occurs, which may require extra steps to secure the device.
5.
Protection Periods
5.1
The protection periods will commence when one of the system requirements described in Clause 2.1 is met.
5.2
GamBlock® protection periods are per device.
5.3
Gamblock Pty Ltd is not obliged to remove GamBlock® during a protection period from a device upon request. I hereby release Gamblock Pty Ltd from any liability or claims whatsoever arising out of or connected with Gamblock Pty Ltd not removing GamBlock® during a protection period.
GamBlock® New Apple Mobile Device Agreement
iOS devices are leased from Gamblock Pty Ltd and are owned by Gamblock Pty Ltd at all times, irrespective of whether GamBlock® Membership blocking is active or expired, or repurchased. Attempting to sell an iOS device leased from Gamblock Pty Ltd may void all warranties.
The hardware warranty applies in accordance with the hardware warranty of the country of purchase.
Gamblock Pty Ltd is not obliged to deactivate GamBlock® Membership blocking during a GamBlock® Membership period from an iOS device upon request by the lessee. The lessee hereby releases Gamblock Pty Ltd from any liability or claims whatsoever arising out of or connected with Gamblock Pty Ltd not deactivating GamBlock® Membership blocking from the iOS device.
GamBlock® blocks all forms of online gambling, including, but not limited to, gambling information, hidden gambling (not displayed on the computer/mobile phone or device), spread betting, fantasy games, lotteries, bingo, sportsbook, sweepstakes, gambling software and sites that pertain to "real world" gambling.
GamBlock® memberships are per mobile device.
Your Apple Device - Variable Blocking, configured by Mac Agreement
I have access to a Mac computer running OS 14 or above and a cable to connect it with my device, and authorise Gamblock Pty Ltd staff to connect to my Mac computer.
All important data will be backed up as GamBlock® Your Apple Device - Variable Blocking performs a factory reset.
Your Apple Device - Variable Blocking, configured by Mac is for a device owned by you and not a third party. If Your Apple Device - Variable Blocking, configured by Mac is purchased for company use, it must be purchased by an authorised representative of the company. If a device owned by you is managed or in any way regulated by a third party, it must be purchased by the third party or consent must be given by the third party for you to purchase the product.
Gamblock Pty Ltd is not obliged to deactivate GamBlock® Membership blocking during a GamBlock® Membership period from an iOS device upon request. I hereby release Gamblock Pty Ltd from any liability or claims whatsoever arising out of or connected with Gamblock Pty Ltd not deactivating GamBlock® Membership blocking from the iOS device.
By default, GamBlock® is unable to be removed during a protection period. A second person, such as a sponsor, loved one or counsellor can choose to be responsible for irremovability during the first thirty days of a protection period. If it is chosen to hand back irremovability responsibility to GamBlock®, a fee of $USD 20.00 is required for GamBlock® security to be confirmed again via a Mac computer running OS 14 or above and a cable to connect it with the iOS device. If a new installation is required, the 30 days will commence again, upon new installation completion.

Multiple Platforms and Products Agreement

System Requirements

(a)
The GamBlock® Purchase app must be used to check compatibility on Android devices.

(c)
In order to setup GamBlock® Comprehensive on an iPhone or iPad provided by the customer, it must have access to a Mac computer running OS 10.12.22 or above and a cable to connect it to the iPhone or iPad. All important data will be backed up as a factory reset is performed. Restore from a backup using iTunes or iCloud is blocked. The device is used as a new device.
2.2
If a system requirement described in Clause 2.1 is not met, the protection period cost of the device pertaining to that system requirement will be added to the protection period of a device/s that meets the system requirements described in Clause 2.1.
3.

GamBlock® for iPhones and iPads Agreement

2.1
An Advanced User is a user who is familiar with general settings.
2.2
A Power User is a user who uses specialised features of hardware, operating systems, programs, or web sites, which are not used by the average user.

A General User or Advanced User can upgrade to Power User protection at any time during a protection period.
2.4
Any user can transfer protection to a Samsung device with Android Version 7.0 or greater installed or a Windows desktop computer with Windows 7 or greater installed.
3.

5.
Functionality
5.1
Browsers
5.1.1
iOS Power Users can use any browser.
5.1.2
iOS General Users will no longer be able to use third party browsers or the default Safari browser for accessing the internet after the installation of GamBlock® for iOS General Users, due to the architecture of the operating system. All browsing during the protection period will be conducted from the GamBlock® authorised browser.
5.2
Backup
5.2.1
iOS Power Users requires that all important data will be backed up as a factory reset is performed. Restore from a backup using iTunes or iCloud is blocked.
5.3
Passwords
5.3.1
GamBlock® becomes a macOS Administrator and makes the user a macOS Standard User in order to provide the level of protection required to block gambling on macOS.
5.3.2
A password is created during macOS setup, after which the original password can be used or changed.
6.
Removal
6.1
Attempting to remove GamBlock® for iOS General Users can cause data loss.
6.2
Attempting to remove GamBlock® for iOS General Users requires an upgrade to GamBlock® for iOS Power Users.
7.
Blocking
7.1
GamBlock® blocks all forms of online gambling, including, but not limited to, gambling information, hidden gambling not displayed on the device, spread betting, fantasy games, lotteries, bingo, sportsbook, sweepstakes, gambling software and sites that pertain to "real world" gambling.

GAMBLOCK® END USER SOFTWARE LICENCE
NOTICE
PERMISSION TO USE THIS GAMBLOCK® SOFTWARE ("SOFTWARE") IS CONDITIONAL UPON YOU AGREEING TO THE TERMS OF THIS END USER SOFTWARE LICENCE ("LICENCE') SET OUT BELOW SO PLEASE READ IT CAREFULLY. DO NOT PURCHASE OR INSTALL OR USE THE SOFTWARE UNTIL YOU HAVE READ AND ACCEPTED ALL THE TERMS OF THIS LICENCE. IF YOU CLICK "I ACCEPT" AT THE END OF THE LICENCE AND THEN EITHER PURCHASE OR INSTALL OR USE THE SOFTWARE YOU WILL BE DEEMED TO HAVE ACCEPTED THE LICENCE. IF YOU DO NOT WISH TO ACCEPT THE LICENCE DO NOT CLICK "I ACCEPT" AND DO NOT PURCHASE OR INSTALL OR USE THE SOFTWARE.

1. | Grant of Licence |
1.1 | Subject to acceptance and the strict compliance by You with the terms and conditions of this Licence You may acquire a non-exclusive and non-transferable right to install and use the Software. |
2. | Conditions of Licence |
2.1 | Except as expressly authorised in this Licence or by the Copyright Act 1968 (C'th) you must not, and must not allow or cause any other person to: |
(a) | translate adapt, vary, modify, or reverse engineer the Software or any part thereof without the express consent of Gamblock; |
(b) | sell, lease, hire, or licence the Software or any part thereof or attempt to do any of these acts; |
(c) | engage in any act which infringes Gamblock's intellectual property rights in the Software; |
(d) | alter, change, remove or obscure any notices or other indications (including copyright notices) as to ownership of the Software. |
2.2 | You must supervise the use of the Software to ensure that it is used in accordance with the terms of this Licence. |
3. | Warranty |
To the extent permitted by law, the Software is provided "as is" without any warranties or representations, express or implied, including without limitation warranties and/or representations relating to the fitness for a particular purpose or merchantability of the Software or the ownership of the intellectual property rights in the Software. | |
4. | Limitation of Liability |
4.1 | To the extent permitted by law, Gamblock does not accept any liability for any loss or damage whatsoever or howsoever incurred by any person (whether direct or indirect, incidental, special or consequential), including but not limited to loss or damage to person or property, wasted expenditure, loss of income or profits, loss of business opportunity or other tangible or intangible loss, damage or consequential loss (even if Gamblock has been advised of the possibility of such loss or damage) resulting from: |
(a) | the use of the Software; |
(b) | access by users of the Software to any internet site, including without limitation internet gambling sites; or |
(c) | not having the Software removed from an operating system after a request to do so has been made. |
4.2 | Any term, condition or warranty implied by law or otherwise in respect of the supply of the Software which is not capable of exclusion but is capable of limitation is hereby limited to the resupply of the Software. |
5. | Intellectual Property Rights |
5.1 | You acknowledge that all intellectual property rights in the Software and associated documentation are owned by or licensed to Gamblock. |
5.2 | You shall not challenge or assist a third party challenge of Gamblock's intellectual property rights in the Software and associated documentation. |
5.3 | If you become aware of any infringement of the intellectual property rights in the Software or any breach of this Licence you will immediately notify Gamblock. |
6. | Release and Indemnity |
6.1 | You will not under any circumstances have any cause of action against, or right to claim or recover from, Gamblock for or in respect of any loss, damage or injury including without limitation any loss of profit, indirect or consequential loss, damage or injury whatsoever, howsoever arising from the installation or use of the Software or any breach of this Licence. |
6.2 | You agree to indemnify absolutely Gamblock and its officers, employees and agents from and against all actions, claims and demands instituted against Gamblock, its officers, employees or agents and any losses or expenses incurred by Gamblock its officers, employees or agents arising out of a breach of this Licence by You or your use of the Software. |
7. | Term of Licence |
7.1 | Subject to the terms set out in this Licence, this Licence shall continue for a period of one year from the date of installation of the Software. Thereafter, You may enter into a further licence with Gamblock for the continued use of the Software on Gamblock's then current terms and conditions, including but not limited to the payment of any licence fee. |
7.2 | This Licence may be terminated at any time by Gamblock. |
7.3 | Upon termination You shall destroy any remaining copies of the Software and associated documentation or otherwise return or dispose such material in the manner directed by Gamblock. |
7.4 | The expiration or termination of this Licence shall not effect any rights or remedies which Gamblock may have otherwise under this Licence or at law. |
8. | Waiver |
The waiver of any party to enforce at any time the provisions of this Licence or any rights in respect thereto or to exercise any election herein provided shall in no way be considered a waiver of such provisions, rights or election to otherwise in any way effect the validity of this Licence. | |
9. | Governing Law |
This Licence shall be governed by and construed in accordance with the laws applicable in the State of Victoria, Australia and each party hereby submits to the exclusive jurisdiction of the Courts of Victoria and to the courts of appeal therefrom. | |
10. | Severability |
If any provision of this Licence is held invalid, unenforceable or illegal for any reason this Licence shall remain otherwise in full force apart from such provision which shall be deemed deleted. | |
11. | Refunds |
No refunds of any licence fee paid will be given under any circumstances. | |
12. | Privacy |
The Software may collect certain non-personal information, including, but not limited to, operating system type, ip address and web browser version, exclusively for improving the Software and monitoring any breach of this licence. Any such information collected will not be disclosed to any third parties. | |
13. | Removal |
You acknowledge that Gamblock is not obliged to remove the Software from any device on which it may be installed even on request to do so. | |
14. | Functionality |
14.1 | You acknowledge and accept that some versions of the Software may limit some features of the operating system and other software running on the operating system, including, but not limited to, Safe Mode. |
14.2 | On some platforms, only the GamBlock® Browser or one specific browser is permitted for use, and all other browsers may be restricted or blocked as part of the Software's functionality to ensure compliance with gambling prevention measures. |
14.3 | On certain platforms, apps may need to be explicitly permitted in order to function. On other platforms, you may have the option to only allow apps that have been pre-approved. |
15. | Technical Support ("Support") |
Support refers to assistance given by Gamblock in the blocking of access to gambling related activities from websites. | |
15.1 | Support shall be provided by Gamblock for one year from the date of installation of the Software unless otherwise agreed in writing and subject to the terms below. |
15.2 | Gamblock may, at its option, decline to give Support, where in its opinion; |
(a) | The Software functions on any operating system that is non-genuine, infected with viruses, malware or is otherwise corrupted; or |
(b) | Software associated files are not permitted through a firewall in order for the Software to be updated; or |
(c) | purchase confirmation for the Software is not provided to Gamblock upon request; or |
(d) | communication of a threatening, abusive or offensive nature is directed at Gamblock, it's employees servants or agents; or |
(e) | Beta or Trial versions of operating systems are used; or |
(f) | the Software pre-installation instructions provided at www.gamblock.com are not followed; or |
(g) | the Software pre-installation scan results from anti-crimeware programs described at www.gamblock.com are not stored prior to installing the Software and forwarded to Gamblock upon request; or |
(h) | advice provided to Gamblock by Microsoft Certified Professionals and communicated to You in relation to the operation of the Software on your device or on any related issue is disputed by You; or |
(i) | advice or recommendations from Gamblock is not followed or is disputed by You; or |
(j) | communication of an emotive or non-technical nature is directed at Gamblock, it's employees servants or agents. |
(k) | attempts are made to install the Software on a device managed by a system administrator, without the system administrator’s permission. |
(l) | ongoing support becomes unreasonable due to instructions not being followed at the time of protection period cessation and the device, and / or applications are no longer supported by GamBlock®, or third-party platforms that the Software is installed on or with are no longer supported. |
15.3 | You acknowledge and agree that if: |
(a) | You require Support from Gamblock, You will follow the instructions provided by Gamblock directed at providing or facilitating the Support; |
(b) | You refuse to follow the instructions provided by Gamblock, aimed at providing or facilitating Support, then Gamblock is entitled to decline to provide any further Support. |
(c) | If GamBlock® Ultimate is required to follow Support instructions, the equivalent cost will be taken off the end of the protection period. |
(d) | You initiate or partake in a communication of an emotive or non-technical nature directed at Gamblock or any of its employees, servants or agents, Gamblock may, at its option, require that a certified gambling harm counsellor is included in all further communications with You. |
(e) | You submit a Counselor ID, Gamblock may, at its option, require that the certified gambling harm counsellor that Gamblock provided with the Counselor ID, is included in all further communications with You. |
15.4 | You acknowledge and agree that: |
(a) | Gamblock may, at its option, forward any communication from You of a threatening nature directed at Gamblock, its employees, servants or agents to an appropriate authority or law enforcement agency. |
(b) | If I change devices or my device operating system changes, I will implement Gamblock’s solution for that device or operating system. |
(c) | Third party software should only be installed if it contains a digital signature. | (d) | Gamblock may, at its option, forward any communication from You that Gamblock considers to be hate speech, cyberbullying, cyberbullying material, cyber abuse, cyber abuse material, sharing of intimate images, threat to share intimate images, illegal content or restricted content directed at Gamblock, its employees, servants or agents to the eSafety Commissioner and \ or the Equal Opportunity and Human Rights Commission. |
15.5 | Meetings |
a) | Support assistance meeting times, including but not limited to, remote assistance meeting times must be agreed to by Gamblock and the user prior to commencement. |
b) | 48 hours notice must be provided by the user to Gamblock prior to the cancelation of an assistance meeting. |
c) | Not meeting at an agreed time or cancelling a meeting in less than 48 hours lowers the user’s position in the Support queue. |
d) | Where not meeting at an agreed time or cancelling a meeting in less than 48 hours occurs repeatedly, Gamblock may, at its option, require that a certified gambling harm counsellor or health professional is included in all further communications with You. |
e) | When agreed appointment times are missed, in Gamblock’s opinion, Gamblock may, at its option, suspend support until the user commits to keeping appointments. |
16. | Use of Third-Party Software |
16.1 | You acknowledge and agree that Gamblock may utilize third-party software as part of its service to help block gambling activities. |
16.2 | The use of any third-party software is subject to the terms and conditions of the respective third-party provider, and it is your responsibility to comply with those terms. |
16.3 | By accepting this Licence, you grant Gamblock permission to use other third-party software as necessary to provide the service. |
16.4 | Gamblock shall not be liable for any issues, claims, damages, or losses arising from the use of third-party software. You agree to indemnify and hold harmless Gamblock, its officers, employees, and agents from any and all claims, damages, or losses related to the use of other third-party software as part of Gamblock"s service. |
16.5 | You acknowledge that Gamblock does not own or control third-party software and is not responsible for any changes, updates, or discontinuation by its provider. |
17. | Protection Periods |
17.1 | A protection period is the amount of time for which gambling is blocked. |
17.2 | A protection period can be a licence period or membership period. |
17.3 | A protection period commences when system requirements are met and the GamBlock® software has been installed. |
17.4 | Protection periods are per device. |
17.5 | Gamblock Pty Ltd is not obliged to remove GamBlock® during a protection period from a device upon request. I hereby release Gamblock Pty Ltd from any liability or claims whatsoever arising out of or connected with Gamblock Pty Ltd not removing GamBlock® during a protection period. |
17.6 | Unused protection periods are added to the protection periods of devices already within a protection period. |
17.7 | I am entitled to an extra month’s protection for protection periods over one year if I do not require remote assistance during my protection period. |
17.7 | I am entitled to an extra week’s protection for protection periods under one year if I do not require remote assistance during my protection period. |
18. | Transfers |
18.1 | I acknowledge that I am bound to the agreements and information pertinent to the platforms mentioned in this website when transferring platforms. |
18.2 | In the event that a system requirement pertinent to the platforms mentioned on this website is not met by a device, the protection period can be transferred to another platform where the system requirements are met. |
18.3 | If the protection period is transferred to another product and the protection period pricing of the new product is less than the original product at the time of transfer, the protection period will be extended accordingly. |
18.4 | If the protection period is transferred to another product and the protection period pricing of the new product is more than the original product at the time of transfer, the protection period will be reduced accordingly. |
19. | Survivorship |
Clauses 3, 4, 5, 6, 7, 11, 13, 14, 15, 16, 17 and 18 of this Licence survive the expiration or termination of this Licence. |
